Buku ini merupakan ikhtiar penulis dalam melakukan redefinisi, klasifikasi dan kaidah-kaidah ilmiah terhadap teori Teori Hak, Teori Harta, dan Istislahi serta Aplikasinya dalam Fikih Kontemporer khususnya permasalahan perlindungan hak cipta. Teori-teori dirasa perlu mengingat perkembangan dunia bisnis yang semakin maju. Perkembangan ini menuntut kearifan fukaha memahami persoalan kontemporer dan menjelaskan hukum-hukum terkait dalam kacamata fikih ketika tidak ada nash secara eksplisit berbicara tentang itu. Penulis berusaha mengintegrasikan fikih mazhab dengan pemahaman kontemporer terhadap definisi, ketercakupan dan penerapan teori hak, harta dan istislahi guna membedah persoalan kekinian. Sementara problematika hak cipta yang semakin mewacana perlu dikaji sebagai usaha ijtihadiah guna menyahuti kebutuhan umat dalam kehidupan modern. Perubahan paradigma terhadap hak individu dan hak-hak publik, otoritas penggunaan hak, kaidah-kaidah maslahah (public interest) dalam bingkai qasd (sasaran) al-Syari dan gasd mukallaf dikupas secara komprehensif dalam buku ini. Dengan demikian, teori tersebut dapat digunakan dalam menganalisis persoalan hari ini yang semakin kompleks. Sementara kajian tentang harta (al-mal) itu menjadi bagian klasifikasi hak; al-haqq mali (hak terkait harta) dan al-haqa ghayr al-mali (hak nonharta). Selain itu, penulis juga mendeskripsikan kaidah-kaidah penggunaan hak dalam frame kemaslahatan yang baiance (seimbang) antara hak individu dan hak masyarakat dalam mengakses kebutuhan, baik materi maupun nonmateri. Sejarah peradaban Islam merupakan salah satu bidang kajian studi Islam yang banyak menarik perhatian para peneliti, baik dari kalangan muslim maupun nonmuslim. Sejarah adalah gambaran masa lalu tentang manusia dan sekitarnya sebagai makhluk sosial, yang disusun secara ilmiah dan lengkap, meliputi urutan fakta masa tersebut dengan tafsiran dan penjelasan yang memberi pengertian dan kepahaman tentang apa yang telah berlalu. Buku ini menguraikan tentang sejarah peradaban Islam secara umum; Jazirah Arab sebelum Islam dari berbagai aspeknya, Umayah Timur dan Barat, Abbasiyah, dinasti-dinasti lain di dunia Islam, tiga dinasti besar; imperialisme Barat terhadap dunia Islam; Islam dan peradabannya di Nusantara dan Indonesia; serta kontribusi Islam terhadap ilmu pengetahuan dan filsafat. Maka diharapkan buku ini berfungsi sebagai sumber belajar bagi mahasiswa yang mengalami kesulitan membaca literature sejarah peradaban Islam dalam bahasa Arab dan bahasa Inggris.

KEWARISAN ANAK ANGKAT YANG BERKEDUDUKAN SEBAGAI ASHÂBUL FURÛDH (Analisis Terhadap Putusan Pengadilan Agama No. 287/Pdt.G/2006/PA.Pdg.)

<p><em>The Case No. 287/ Pdt. G/ 2006/PA. Pdg. is a lawsuit Wasiat Wajibah submitted to the Religious Court of Padang. The Religious Court of Padang sets the plaintiff on this case as an adopted child who is entitled to obtain a mandatory will from his foster mother's estate. Where as between the plaintiff and his adoptive mother has a very close kinship relationship. The plaintiff is the real child of his adoptive brother's brother, while at that moment the plaintiff's adoptive mother was the heir of Kalâlah. The Law of Inheritance of Islam recognized the right of inheritance to the sister’s child. Sister’s son's inheritance is not clearly contained in the Qur'an and the hadith of the Prophet Muhammad pbuh. However, sister’s child's inheritance rights are basically through the extension of the understanding of other whose rights are described in the Qur'an, because if he or she has no sister and brother, the position can be replaced by the child. Sister’s child will not get the right as long as his father who connects him to the heir is alive. This can be understood as the concept of "Expanding Brotherhood Meanings". Thus, the decision of the Religious Court of Padang on the Wasiat Wajibah which sets the plaintiff to obtain the right to the property of his adoptive mother through Wasiat Wajibah is not appropriate. This is because the plaintiff has a very close kinship with his adoptive mother. Therefore, the plaintiff is more aptly part of the heritage of his adoptive mother through his right as an heir (ashâbul furûdh), not as a mandatory will. This is because the plaintiff replaces the position of his biological father as the heir because he has died earlier than his adoptive mother. The Plaintiff is entitled to receive a share of furûdh against the inheritance of his adopted mother. The furûdh portion obtained is based on the letter of al-Nisâ verse 176.</em></p>

A MODEL OF DISCOVERY LEARNING BASED - TEXT BOOK OF CHARACTER AND ISLAMIC EDUCATION: AN ACCURACY ANALYSIS OF STUDENT BOOK IN ELEMENTARY SCHOOL

This study aims at developing a valid discovery-learning text book for the Islamic Education (<em>PAI</em>) and Character subject delivered at the fifth grade of Primary School based on the results of the accuracy analysis of the existing student books. This is a Research and Development (R and D) applying the 4-D model proposed by Semmel and Thiagarajan, that is, defining, designing, developing, and disseminating. Data collection techniques used (1) instrument assessment with the format of student book analysis to measure the level of accuracy of the existing textbooks, (2) interviews and observations, conducted to the <em>PAI</em> teachers, and (3) validation sheets. Moreover, the technique of data analysis used inter rater analysis technique, known as the technique of intra class correlation coefficient analysis (Intraclass Correlation Coefficient-ICC). As the result, in terms of level of accuracy, the existing textbooks of Character and Islamic Education at the fifth grade of elementary school is still low. In general, the teachers claim that the existing text books are able to meet some of the basic competencies and indicators. However, the text books need to be refined and clarified the student learning activities, making it more simple for students to learn. On the other hand, the product of discovery learning textbooks on the subjects of Character and Islamic Education  at the fifth grade of elementary school are declared valid. This product is refined based on input, making it feasible for the students at the fifth grade of Primary School in learning Character and Islamic Education.
