TINJAUAN FIKIH TERHADAP AKTIVITAS PERDAGANGAN DI PASAR BAWAH BUKITTINGGI

This study describes trading activities in Pasar Bawah Kota Bukittinggi.This study olso to review thetrading activities with Fikih Mu'amalah (Islamic Economic Law). The question is whether the behavior that the merchant plays in line with Islamic law or not? This question is important to answer since the majority of traders in Pasar Bawah are Muslim. On the otherhand Prophet Muhammad SAW states that the market is the worst place and mosque is the best place. This statement provides an opportunity for market participants to commit acts deviant or illegal. This study is categorized into qualitative research using field research. Data were taken from interviews and observation. This study found that trading in Pasar Bawah Bukittinggi took place intensely with traditional trading patterns. In these trading activities found many deviations that can be grouped as follow: 1. related to the commodities traded, 2. the form of transactions conducted, 3. violations of the regulations, 4. a neglect of business ethics in Islam.

Sharia And Tradition, Pig Hunting In Minangkabau

This study examined the tradition of hunting pigs among the Minangkabau people. On the one hand the Minangkabau community has a strong religious tradition, on the other hand hunting pigs is in contact with cases contrary to Islam. Then the question is why do the Minangkabau people who are known for their strong adherence to Islamic law preserve the tradition of pig hunting? This study uses field research. Data were collected through interviews with hog hunt participants and through observation at several hunting grounds. The main data sources are participants hunting pigs and hunting activity of pigs themselves. From the results of the study, it was found that the Minang community, especially the participants of pig hunting, did not feel that the tradition of hunting pigs was contrary to the religious law he believed. Hunting pigs is not to implement religion nor is it a tradition that ignores religion. The tradition of hunting pigs and religion is at a different angle. Therefore this tradition can last until now. Matters that are seen to be outwardly opposed to religion can find a solution to compromise it.

Islam mencela segala bentuk meminta-minta untuk memenuhi kebutuhan dan sebaliknya Islam menganjurkan agar dapat bekerja dengan tangan sendiri atau melalui hasil keringat sendiri bukan mengharap balas kasihan dari orang lain. Profesi pengamen merupakan salah satu bentuk fenomena yang terjadi di tengah masyarakat dimana pengamen tersebut memiliki prilaku yang berbedabeda dalam memperoleh keuntungan yaitu dengan cara gelandangan dan dengan cara tidak gelandangan sehingga terdapat perbedaan dalam menetapkan hukum profesi pengamen dalam tinjauan hukum ekonomi syariah.

The purpose of this study was to explain the comparison of financing processes, asset acquisition, and transfer of home ownership financing with Musyarakah Mutanaqisah and Ijarah muntahiyah Bitamlik. The research object was at Bank Muamalat Indonesia, Solok Branch Office and at Bank Rakyat Indonesia Syariah Padang Branch. The type of research used is qualitative comparative research. The data collection technique used is through interviews and documentation. Data processing is done by qualitative comparative analysis techniques. The results of the study are: First, the process of financing home ownership with musyarakah mutanaqisah is longer than ijarah muntahiyah bitamlik. Second, the procurement of assets with musyrakah mutanaqisah is clearer than ijarah muntahiyah bitamlik. Third, the transfer of ownership in the financing of home ownership with Musyarakah Mutanaqisah process is certain, while the transfer of home ownership with Ijarah Muntahiyah Bitamlik the process is uncertain. Fourth, financing using the Musharaka Mutanaqisah agreement is superior to the Ijarah muntahiya bitamlik both in terms of procurement, certainty of ownership transfer and in terms of legality to collateral. Althoughin terms of the process it is faster on Ijarah Muntahiya Bittamlik.

Dunia penuh dengan konflik. Benar seperti yang diurai oleh kalangan Marxian. Sebenarnya tak juga seperti yang diduga Marx, masyarakat tidak ingin terus menerus berada dalam konflik. Masyarakat juga menghendaki kehidupan dengan membangun sejumlah konsensus, meski acapkali yang dijumpai adalah konsensus semu. Kini masyarakat berada di era postindustri. Mereka heterogen, akibat keunikan model kesadaran yang dimiliki setiap warga dunia dalam merespon realitas. Pemikir Weberian, memusatkan perhatiannya pada dunia kesadaran manusia yang unik dan subyektif, di tengah masyarakat dunia yang dinamis dan kompleks.
